About this Personal Injury Settlement Calculator

Canadian courts do not use the multiplier method. This calculator adds your financial losses (treatment and care costs, and lost income) to a pain-and-suffering range for your level of injury, based on typical Canadian awards: about $5,000 to $40,000 for minor injuries, $50,000 to $150,000 for moderate ones, $150,000 to $350,000 for serious permanent injuries, and up to the national cap of about $470,000 for catastrophic ones. The total is then reduced by your share of fault under British Columbia law.

British Columbia rules this calculator applies

Fault rule
Shared fault (apportionment). Your payout drops by your share of fault, but being partly at fault never bars your claim.
Pain and suffering cap
About $470,000 anywhere in Canada, reserved for the most catastrophic injuries (the Supreme Court of Canada cap, indexed for inflation).
Deadline to file
Generally 2 years from when you knew, or ought to have known, about the injury and its cause. Claims against a municipality or other public body often need written notice much sooner.
Car accidents
Special rules apply in British Columbia; see below.

Car accidents in British Columbia

Since May 1, 2021, injuries from a vehicle crash in British Columbia are covered by ICBC Enhanced Care benefits instead of a lawsuit, whoever caused it. The exception: if the at-fault driver is convicted of certain Criminal Code offences, such as impaired driving, you can still sue them.

This applies to anyone hurt in a crash involving a vehicle, including pedestrians, cyclists and passengers. Slip and fall, dog bite, medical malpractice and other injuries follow the ordinary rules above.

Frequently asked questions

8 questions
How does the personal injury settlement calculator work?
It estimates your settlement by adding financial losses and a pain-and-suffering range, then adjusts for your share of fault.
How does shared fault affect my settlement in Burnaby?
Your settlement is reduced by your share of fault but isn't barred by partial fault.
What is the deadline for filing a personal injury claim in British Columbia?
The basic limitation period is 2 years from when you knew or ought to have known of the injury and its cause.
What happens after a car accident in British Columbia?
Injuries are covered by ICBC Enhanced Care benefits, not a lawsuit, unless the at-fault driver is convicted of certain Criminal Code offences.
Should I accept the first insurance offer?
Consider consulting a lawyer before accepting, as initial offers may not reflect the full value of your claim.
How long do personal injury claims take in British Columbia?
The duration varies based on case complexity, negotiations, and court schedules. Consult a lawyer for specific timelines.
What medical documentation is important for my claim?
Medical records, treatment plans, and expert assessments are crucial for substantiating your injury and its impact.
How do contingency fees affect my settlement?
Lawyers typically take a percentage of the recovery, which reduces your net settlement amount.
