Our firm ensures the title to your land and property if you purchase it once you get a property in the Land Titles System. Land Titles System was an initiative introduced by the Province of New Brunswick in 2001. Over time, all property in New Brunswick is expected to be converted. Conversion is required for land sold or mortgaged. There are some exceptions. The Province of New Brunswick then guarantees title after the conversion. The conversion to land titles is done by examining all title deeds and any other records in the Registry Office. The Province is then issued a Certificate of Title with all the information. A Certificate of Title is then sent to the Province. The Certificate certifies that the owner of the parcel has been identified and paid the charges. We will make sure that the Vendor of the property is the rightful owner and that the property is not subject to any charges or liens. Before closing the transaction, we will make arrangements to correct any title discrepancies. We will have any mortgages that are not yours canceled or the Vendor will provide the release at a later time. We will notify you of the next steps if we cannot resolve or rectify any issues in your title. Taxes on real property and water/sewage will be verified as well as other assessments and levies. We will prepare a Statement of Adjustments between you and the vendor concerning the outstanding deposits and fees acquired during the time the vendor was occupying the property. This includes also real property taxes and water and sewerage. The Deed is also to be reviewed by us and prepare the required affidavit for your deed to be recorded at the Registry Office.
