About this Personal Injury Settlement Calculator

Canadian courts do not use the multiplier method. This calculator adds your financial losses (treatment and care costs, and lost income) to a pain-and-suffering range for your level of injury, based on typical Canadian awards: about $5,000 to $40,000 for minor injuries, $50,000 to $150,000 for moderate ones, $150,000 to $350,000 for serious permanent injuries, and up to the national cap of about $470,000 for catastrophic ones. The total is then reduced by your share of fault under Ontario law.

Ontario rules this calculator applies

Fault rule
Shared fault (apportionment). Your payout drops by your share of fault, but being partly at fault never bars your claim.
Pain and suffering cap
About $470,000 anywhere in Canada, reserved for the most catastrophic injuries (the Supreme Court of Canada cap, indexed for inflation).
Deadline to file
Generally 2 years from when you knew, or ought to have known, about the injury and its cause. Claims against a municipality or other public body often need written notice much sooner.
Car accidents
Special rules apply in Ontario; see below.

Car accidents in Ontario

For a car accident in Ontario, you can claim pain and suffering only for a permanent serious impairment or disfigurement, and in 2026 $47,913 is deducted from any award under $159,709. Your own accident benefits pay first, whoever caused the crash.

This applies to anyone hurt in a crash involving a vehicle, including pedestrians, cyclists and passengers. Slip and fall, dog bite, medical malpractice and other injuries follow the ordinary rules above.

How does shared fault affect my settlement in Ontario?
Your payout decreases by your share of fault, but being partly at fault doesn't bar your claim.
