About this Personal Injury Settlement Calculator

Canadian courts do not use the multiplier method. This calculator adds your financial losses (treatment and care costs, and lost income) to a pain-and-suffering range for your level of injury, based on typical Canadian awards: about $5,000 to $35,000 for minor injuries, $35,000 to $100,000 for moderate ones, $100,000 to $225,000 for serious permanent injuries, and up to the national cap of about $470,000 for the most catastrophic ones. Where in that range a case falls depends on the factors Canadian courts weigh (the Stapley factors): your age, the nature of the injury, how severe and long-lasting the pain is, disability, emotional suffering, and how much it affects your work, hobbies, relationships and independence. Because core medical treatment in Canada is publicly funded, what you spent on treatment is not used as a measure of how serious the injury is. The total is then reduced by your share of fault under Ontario law.

Ontario rules this calculator applies

Fault rule
Shared fault (apportionment). Your payout drops by your share of fault, but being partly at fault never bars your claim.
Pain and suffering cap
About $470,000 anywhere in Canada, reserved for the most catastrophic injuries (the Supreme Court of Canada cap, indexed for inflation).
Deadline to file
Generally 2 years from when you knew, or ought to have known, about the injury and its cause. Claims against a municipality or other public body often need written notice much sooner.
Sexual assault
Treated differently: the cap on pain and suffering does not apply, and many provinces, including British Columbia, have no limitation period for these claims.
Wrongful death
Not covered by this calculator. Who may claim after a death, and what they may claim, differs from province to province; in British Columbia, for example, pain and suffering cannot be claimed after death. A lawyer can tell you what applies.
Not included
Cost of future care and in-trust awards (for family members who cared for you) can add substantially to a serious claim. A lawyer will assess them.
Car accidents
Special rules apply in Ontario; see below.

Car accidents in Ontario

For a car accident in Ontario, you can claim pain and suffering only for a permanent serious impairment or disfigurement, and in 2026 $47,913 is deducted from any award under $159,709. Your own accident benefits pay first, whoever caused the crash.

This applies to anyone hurt in a crash involving a vehicle, including pedestrians, cyclists and passengers. Slip and fall and dangerous premises, defective products, assaults, dog bites, sports injuries, and medical or dental negligence follow the ordinary rules above.

General information about Ontario law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

9 questions
How does the personal injury settlement calculator work?
The calculator estimates settlements by adding financial losses to a pain-and-suffering range based on injury severity, then adjusts for your share of fault.
What affects my personal injury settlement in Ontario?
Factors include injury severity, financial losses, shared fault, and for vehicle crashes, the serious impairment threshold and deductible.
How does shared fault impact my settlement in Ottawa?
Your settlement is reduced by your share of fault, but you can still claim even if partly at fault.
What is the deadline for filing a personal injury claim in Ontario?
In Ontario, the basic limitation period is 2 years from when you knew or should have known about the injury and its cause.
What happens after a car accident in Ontario?
For pain and suffering claims, injuries must be permanent and serious. Accident benefits cover initial costs, regardless of fault.
Should I accept the first insurance offer for my injury?
Insurance offers may not reflect full compensation. Consider consulting a professional before accepting.
How long does a personal injury claim take in Ontario?
The duration varies based on case complexity, evidence, and negotiations. It can take months to years.
What medical documentation is important for my claim?
Medical records, treatment plans, and doctor’s reports are crucial for substantiating your injury and its impact.
How do contingency fees affect my net settlement?
Contingency fees mean lawyers are paid a percentage of your recovery, reducing your net amount but aligning interests.
