Family mediation is a process that a couple can undergo in order to try to settle the terms of their separation or divorce, with the assistance of an accredited family mediator. The mediator can be a lawyer, notary, guidance counselor, psychologist, social worker or psychoeducator, but they must be accredited. Furthermore, the mediator has no coercive power, that is to say, they cannot force one of the parties to provide any information or document whatsoever, and they cannot force people to respect the agreements that would be made in mediation. The mediator also cannot, even if they are a lawyer or notary, give you legal advice during the mediation process. Their role is more that of an intermediary, who seeks to facilitate discussion between the ex-spouse(s) and to explore possible solutions to the various problems raised by the parties. Mediation can sometimes resolve only one of the points in dispute even if it is not possible to find solutions on other points. For example, the parties could agree on the terms of child custody, but not agree on the determination of the income of one of the parents for the purpose of fixing the alimony that would be payable, or even on the sharing of the family residence. If you opt for family mediation, know that you can end it at any time, without any formality other than a written notice to this effect to the mediator and your spouse. Although the parties' lawyers cannot be present and accompany their client during family mediation sessions, it is possible for you to consult us throughout the mediation process to know your rights and obligations, and to ensure that you reach the right agreements, all without jeopardizing the mediation process. Our role is then that of an advisor, which is intended to be more removed from the process and solely for the purpose of ensuring your protection and that of your children.
