About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under California law.

California rules this calculator applies

Fault rule
Pure comparative fault. Your payout drops by your share of fault, but you can still recover even if you were mostly at fault.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in California. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about California law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

9 questions
How does the car accident settlement calculator work?
The calculator estimates economic damages (medical bills, lost wages) and adds pain and suffering using a multiplier on medical costs, adjusted for accident type.
What factors affect my settlement amount in Alameda?
Factors include medical expenses, lost wages, pain and suffering, and your share of fault. Alameda's cost of living and traffic patterns may indirectly influence settlements.
How is pain and suffering calculated in California?
Pain and suffering are estimated using a multiplier (1.5 to 5) on medical costs, based on injury severity.
Does my share of fault impact my settlement in California?
Yes, under pure comparative fault, your payout is reduced by your share of fault but you can still recover even if mostly at fault.
What is the deadline to file a car accident claim in California?
You have 2 years from the date of injury to file a personal injury claim. Government claims require earlier notice.
Should I accept the insurance company's first offer?
It's generally advised to evaluate the offer carefully, as initial offers may not fully cover your damages.
How long does it take to settle a car accident claim?
Settlement times vary widely, often taking several months to over a year, depending on case complexity and negotiations.
Which medical documents are important for my claim?
Keep all medical bills, treatment records, and doctor's notes, as they substantiate your injuries and treatment costs.
How do lawyer fees affect my net settlement amount?
Lawyer fees, typically 33% to 40% of the settlement, are deducted from your total recovery, affecting your net amount.
