Most of my Bakersfield and Fresno disability clients come to me after the Social Security Administration has denied their disability applications. These people are frequently confused and frustrated by the Social Security disability process because they know that they are disabled, and they don’t understand how the Social Security Administration could deny their claim. The most important thing to know about denials of disability applications is that you should not give up. The fact is that the Social Security Administration denies most applications during the first evaluation; only 35 percent of claims are granted disability benefits at that point. If your claim has been denied, be persistent and get an experienced California Social Security disability lawyer to appeal your case. The success rate on appeal when claimants are represented by experienced Fresno disability lawyers is much better than at the initial application stage.

How this Bakersfield long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any SSDI offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.

California rules this calculator applies

Deadline to act
For an ERISA employer plan, file your internal appeal within 180 days of the denial letter; you cannot sue until it is decided.
Discount rate
Future benefits are discounted at 3%, a common buyout assumption.
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
SSDI offset
Most employer plans reduce your LTD benefit by any Social Security Disability (SSDI) you receive (about $1,630 a month on average in 2026).
Tax
If your employer paid the premiums, or you paid them with pre-tax dollars, LTD benefits and settlements are taxable income. If you paid with after-tax money, they are generally not. Get tax advice before you sign.
ERISA plans
Most employer plans are governed by ERISA: you must file an internal appeal within 180 days of the denial before you can sue, the insurer usually has 45 days (plus one 45-day extension) to decide, and the case is then heard by a judge on the written record. ERISA allows back benefits, reinstatement and attorney fees, but no jury and no punitive or emotional-distress damages. Individual, government and church plans fall outside ERISA, so state law applies: you can usually sue in state court, and bad-faith damages may be available.
California
California bans discretionary clauses in disability policies (Insurance Code 10110.6), so courts review denials without deferring to the insurer.

General information about California disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

9 questions
How does the long-term disability settlement calculator work?
The calculator estimates back pay, future benefits to age 65, their present value, and a typical lump-sum settlement range based on your claim status and details.
Why might my long-term disability settlement be less than full value?
Settlements are typically 30-75% of future benefits' present value, reflecting risk and negotiation factors. Back pay is added separately.
What if my long-term disability claim is denied in California?
If denied, you can appeal under ERISA within 180 days or sue under state law if ERISA doesn't apply. California law reviews without deferring to insurers.
What is a long-term disability buyout?
A buyout is a lump-sum settlement offered by insurers to close a claim. It's typically 30-75% of the present value of future benefits.
Are long-term disability settlements taxable in California?
If premiums were employer-paid or pre-tax, settlements are taxable. If paid with after-tax dollars, they generally aren't. Consult a tax advisor.
What is the difference between own-occupation and any-occupation in LTD policies?
Most policies switch from 'own occupation' to 'any occupation' after 24 months, affecting eligibility for continued benefits.
When should I file an ERISA appeal for a denied LTD claim?
File an internal appeal within 180 days of denial. The insurer has 45 days, plus a possible 45-day extension, to decide.
How accurate is the long-term disability settlement calculator?
The calculator provides estimates based on typical ranges and your specific details. It's not a guarantee of actual settlement amounts.
How is back pay calculated for long-term disability claims?
Back pay is calculated from the months unpaid, reflecting owed benefits if your claim was cut off or denied.
