Workplace Rights Law Group, LLP in Southern California is a law firm that pursues full remedies for workers whose rights were violated or neglected. WRLG lawyers have been representing employers for most of their professional lives, so they are familiar with the process. While we don't accept every case, we do take each employee's story very seriously. All WRLG attorneys are trial lawyers. All of us have been practicing employment law for many years. We know the playbook of employers because we have represented them. This means that we can beat them. California Employment Claims: We represent clients in wrongful termination, discrimination, and harassment, wage & hours, whistleblowers, misclassification, and class action lawsuits. This law provides protections for individuals with mental or physical disabilities, as well as individuals perceived to be disabled (regardless of whether they actually are). Employment discrimination, despite these safeguards, is still a common occurrence. Contact a Los Angeles disability lawyer if you believe you are a victim of discrimination.

How this Riverside long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any SSDI offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.

California rules this calculator applies

Deadline to act
For an ERISA employer plan, file your internal appeal within 180 days of the denial letter; you cannot sue until it is decided.
Discount rate
Future benefits are discounted at 3%, a common buyout assumption.
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
SSDI offset
Most employer plans reduce your LTD benefit by any Social Security Disability (SSDI) you receive (about $1,630 a month on average in 2026).
Tax
If your employer paid the premiums, or you paid them with pre-tax dollars, LTD benefits and settlements are taxable income. If you paid with after-tax money, they are generally not. Get tax advice before you sign.
ERISA plans
Most employer plans are governed by ERISA: you must file an internal appeal within 180 days of the denial before you can sue, the insurer usually has 45 days (plus one 45-day extension) to decide, and the case is then heard by a judge on the written record. ERISA allows back benefits, reinstatement and attorney fees, but no jury and no punitive or emotional-distress damages. Individual, government and church plans fall outside ERISA, so state law applies: you can usually sue in state court, and bad-faith damages may be available.
California
California bans discretionary clauses in disability policies (Insurance Code 10110.6), so courts review denials without deferring to the insurer.

General information about California disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

8 questions
How does the long-term disability settlement calculator work?
The calculator estimates back pay owed, future benefits to age 65, their present value, and a typical lump-sum settlement range based on your claim status and policy details.
What is a long-term disability buyout?
A buyout is a lump-sum payment offered by insurers to settle future benefits. It typically ranges from 30-75% of the present value, depending on claim status.
Why are LTD settlements below full value?
Settlements are below full value because they account for risk, uncertainty, and the insurer's desire to resolve claims without ongoing payments.
What is the deadline to appeal a denied LTD claim in California?
For ERISA-governed plans, you must file an internal appeal within 180 days of denial before you can sue.
How do ERISA appeals work for LTD claims?
You must file an internal appeal within 180 days. The insurer has 45 days, plus a possible 45-day extension, to decide. A judge reviews the written record.
Is a lump sum from an LTD settlement taxable?
If your employer paid the premiums or you used pre-tax dollars, it's taxable. If paid with after-tax money, it's generally not. Consult a tax advisor.
What is the difference between 'own occupation' and 'any occupation' in LTD policies?
Most policies switch from an 'own occupation' to an 'any occupation' test after 24 months, impacting eligibility for continued benefits.
What should I do if my LTD claim is denied in Riverside?
In Riverside, you should consider filing an appeal within 180 days if your plan is governed by ERISA. Consult a professional for guidance.
