ABOUT   Services Excellence Summary

Immigration Law is an extremely complex legal area. The elements that affect whether a foreign national is able to apply for legal status in the U.S. are numerous. Also, many foreign nationals lose their privilege to apply for a green card by overstaying a visa status. In some cases, overstaying a visa may affect the place where an applicant has to apply for a green card. In many cases, in order to get an immigrant Visa, the applicant must process a case through a U.S. Consulate abroad. After entering the U.S., the applicant may apply for a residency card. In order to adjust status in the U.S. (apply for a Green Card), the applicant must be considered eligible. The statutory requirements to determine eligibility are numerous. The applicant must prove that he/she has a lawful status in the U.S. if this status was as a visitor or student. An applicant may be able to apply for a U.S. green card even if he/she has pending prior petitions. If the applicant's previous pending petition is dated before April 30, 2001 and is a case that falls under INA 245, the applicant may qualify to pay a $1,000.00 penalty fee to apply for a Green Card in the U.S. If an applicant is not able to obtain a Green Card in the U.S. he/she may request Consular Processing. The process entails completing the necessary filings and interviewing at the U.S. consulate office in the applicant's native country. The applicant must finalize all the filings within two years for him/her to be eligible for an interview. The total days spent outside the U.S. will range between seven and ten days. The applicant will have time to attain criminal and medical clearance before the interview. You must check to ensure that the interview is confirmed and all documents are in order before you make an effort to attend the interview in the consulate.
