After you pass away, your estate gets distributed through the legal process known as probate. This can happen in one of two ways: testate or intestate. Testate probate occurs when there is a will that outlines how assets will be distributed. This process is generally easier and more straightforward than intestate probate. The court will appoint an executor once the probate process has started. This executor will track down all of the assets, notify any heirs, and pay the decedent's outstanding bills and taxes. They will then distribute any remaining assets according to the instructions laid out in the Probate Court order or the terms of a valid will. If you do not have a valid will, your estate will still go through probate. In Florida, this is known as intestate probate, and this process is governed by intestacy laws. These laws dictate what happens to your assets when you pass away without a valid will. While you still may have an executor, they will be following the default laws, rather than your wishes. States like Florida provide a quicker probate process known as Summary Administration if the estate has been in existence or valued under $75,000 for less than two years. Still, many estates are litigated during the probate process, and this can take many years to complete.
