About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Florida law. In Florida, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

No-fault insurance in Florida

Florida is a no-fault state. After a car accident, your own personal injury protection (PIP) pays 80% of your medical bills and 60% of your lost income, up to $10,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets Florida's serious-injury threshold: a permanent injury, significant and permanent scarring or disfigurement, significant and permanent loss of an important bodily function, or death. Financial losses above your PIP limit can still be claimed.
