This review is written with a heavy heart and a deep sense of betrayal. In mid-2021, facing debilitating circumstances, I filed for Social Security disability. I was vulnerable, desperate for help, and I placed my trust in attorney Shay Fugate on June 3rd, 2022. Initially, we connected over a shared…

How this Orlando long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any SSDI offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.

Florida rules this calculator applies

Deadline to act
For an ERISA employer plan, file your internal appeal within 180 days of the denial letter; you cannot sue until it is decided.
Discount rate
Future benefits are discounted at 3%, a common buyout assumption.
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
SSDI offset
Most employer plans reduce your LTD benefit by any Social Security Disability (SSDI) you receive (about $1,630 a month on average in 2026).
Tax
If your employer paid the premiums, or you paid them with pre-tax dollars, LTD benefits and settlements are taxable income. If you paid with after-tax money, they are generally not. Get tax advice before you sign.
ERISA plans
Most employer plans are governed by ERISA: you must file an internal appeal within 180 days of the denial before you can sue, the insurer usually has 45 days (plus one 45-day extension) to decide, and the case is then heard by a judge on the written record. ERISA allows back benefits, reinstatement and attorney fees, but no jury and no punitive or emotional-distress damages. Individual, government and church plans fall outside ERISA, so state law applies: you can usually sue in state court, and bad-faith damages may be available.

General information about Florida disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

8 questions
How does the Orlando long-term disability settlement calculator work?
The calculator estimates back pay, future benefits, their present value, and a typical lump-sum settlement range based on your claim status, policy type, monthly benefit, SSDI offset, age, and months unpaid.
How accurate is the LTD settlement estimate for Florida?
The estimate uses typical published ranges, not guarantees. It considers factors like policy type and SSDI offsets but individual circumstances vary. Consult a professional for personalized advice.
What is a long-term disability buyout and should I accept one?
A buyout is a lump-sum settlement for future benefits. It typically ranges from 30-75% of their present value, depending on claim status. Consider personal circumstances and consult a professional before deciding.
Why are LTD settlements below full value?
Settlements account for present value and risk, often ranging from 30-75% of future benefits. Factors include claim status, policy terms, and potential legal costs.
What is the deadline for appealing a denied LTD claim in Florida?
Under ERISA, file an internal appeal within 180 days of denial. Insurers usually have 45 days, plus a possible 45-day extension, to decide.
Is tax applied to a long-term disability lump sum in Orlando?
If premiums were employer-paid or pre-tax, the lump sum is taxable. If paid with after-tax dollars, it's generally not. Seek tax advice before accepting a settlement.
What is the difference between 'own occupation' and 'any occupation'?
Most LTD policies initially cover your own occupation, then switch to any occupation after 24 months. This affects eligibility for continued benefits.
What happens if my long-term disability claim is denied in Florida?
For ERISA plans, appeal within 180 days. If denied again, you can sue, but only on the written record. State law applies to non-ERISA plans, allowing potential bad-faith damages.
