About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Florida law. In Florida, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Florida rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in Florida. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Florida

Florida is a no-fault state. After a car accident, your own personal injury protection (PIP) pays 80% of your medical bills and 60% of your lost income, up to $10,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets Florida's serious-injury threshold: a permanent injury, significant and permanent scarring or disfigurement, significant and permanent loss of an important bodily function, or death. Financial losses above your PIP limit can still be claimed.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

How does the car accident settlement calculator work?

What affects a car accident settlement in Florida?
Factors include medical costs, lost wages, pain and suffering, and your share of fault. Florida uses a modified comparative fault rule, reducing payouts by your fault percentage.

The calculator uses a multiplier on medical costs, ranging from 1.5 for minor injuries to 5 for catastrophic ones, adjusted for accident specifics.
Does Florida's no-fault law affect my ability to sue?
Yes, you can only claim pain and suffering if your injury meets Florida's serious-injury threshold, despite PIP covering initial medical bills and lost income.
What is the statute of limitations for car accident claims in Florida?
You generally have 2 years from the injury date to file a personal injury claim. Different rules apply for claims against government bodies or specific cases.
Should I accept the insurance company's first offer?
It's often advisable to evaluate the offer carefully, as initial offers may not reflect the full value of your claim, including pain and suffering.
How long do car accident settlements take in Pinellas Park?
Settlement times vary, often taking months to over a year, depending on case complexity, injury severity, and negotiation dynamics.
What medical documentation is important for a car accident claim?
Keep detailed records of all medical treatments, bills, and any diagnoses related to the accident, as they are crucial for calculating economic damages.
How do lawyer fees impact my settlement in Florida?
Contingency fees, typically 33% to 40%, are deducted from your settlement, affecting the net amount you receive.
Are there unique factors in Pinellas Park that affect settlements?
Local factors like traffic patterns and cost of living may subtly influence settlement amounts, but the core calculation remains consistent with Florida law.
