About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Florida law. In Florida, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Florida rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in Florida. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Florida

Florida is a no-fault state. After a car accident, your own personal injury protection (PIP) pays 80% of your medical bills and 60% of your lost income, up to $10,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets Florida's serious-injury threshold: a permanent injury, significant and permanent scarring or disfigurement, significant and permanent loss of an important bodily function, or death. Financial losses above your PIP limit can still be claimed.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

9 questions
How does the car accident settlement calculator work?
It estimates damages using medical bills, lost wages, and pain and suffering, adjusted for fault under Florida's rules. It provides a range, not a guarantee.
What factors can raise or lower my settlement in Port Charlotte?
Severity of injuries, fault percentage, and medical documentation quality can affect settlement amounts. Local traffic patterns may impact accident details.
How is pain and suffering calculated in Florida?
It's estimated using a multiplier on medical costs, from 1.5 (minor) to 5 (catastrophic), based on injury severity and accident type.
What is the statute of limitations for car accidents in Florida?
You have 2 years from the injury date to file a personal injury claim. Different rules may apply for government claims or specific cases.
Should I accept the insurance company's first settlement offer?
Initial offers may be low. Consider consulting with a professional to evaluate if it's fair based on your damages and legal rights.
How does Florida's fault rule affect my settlement?
Your payout is reduced by your fault percentage. If you're 51% or more at fault, you recover nothing under Florida's modified comparative fault rule.
How long do car accident settlements usually take?
Settlement timelines vary based on case complexity, injury severity, and negotiation length. Some cases resolve in months, others take longer.
What medical documentation is important for my claim?
Accurate medical records, treatment plans, and bills are crucial. They help establish injury severity and support your compensation claim.
How do lawyer fees affect my net settlement amount?
Lawyer fees, often 33% to 40%, are deducted from your settlement. Free consultations are common to discuss potential outcomes.
