About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Florida law. In Florida, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Florida rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in Florida. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Florida

Florida is a no-fault state. After a car accident, your own personal injury protection (PIP) pays 80% of your medical bills and 60% of your lost income, up to $10,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets Florida's serious-injury threshold: a permanent injury, significant and permanent scarring or disfigurement, significant and permanent loss of an important bodily function, or death. Financial losses above your PIP limit can still be claimed.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

9 questions
How does the car accident settlement calculator work?
The calculator estimates economic damages (medical bills + lost wages) and pain and suffering using a multiplier on medical costs, adjusted for accident type and fault.
What is the statute of limitations for car accidents in Florida?
You have 2 years from the date of injury to file a personal injury claim in Florida.
How is pain and suffering calculated in Florida?
Pain and suffering is estimated using a multiplier of 1.5 to 5 on medical costs, depending on injury severity.
Will my settlement be reduced if I was partly at fault?
Yes, under Florida's modified comparative fault rule, your payout decreases by your fault percentage. If over 51% at fault, you recover nothing.
Should I accept the insurance company's first settlement offer?
It's often advisable to review the offer carefully, as initial offers may be lower than the claim's full value.
How long does a car accident settlement take in Port Orange?
Settlement timelines vary widely based on case complexity, negotiation, and court schedules, typically ranging from months to years.
What medical documentation is important for my claim?
Keep detailed records of all medical treatments, bills, and diagnoses related to the accident.
How do lawyer fees affect my settlement amount?
Lawyer fees, often 33% to 40% of the settlement, are deducted from your total payout.
What is unique about car accident claims in Port Orange?
Local factors like traffic patterns and court schedules can influence claims, but general Florida laws apply.
