About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Florida law. In Florida, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Florida rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in Florida. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Florida

Florida is a no-fault state. After a car accident, your own personal injury protection (PIP) pays 80% of your medical bills and 60% of your lost income, up to $10,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets Florida's serious-injury threshold: a permanent injury, significant and permanent scarring or disfigurement, significant and permanent loss of an important bodily function, or death. Financial losses above your PIP limit can still be claimed.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

8 questions
How does the Sanford car accident settlement calculator estimate my claim?
It calculates economic damages (medical bills + lost wages) and estimates pain and suffering using a multiplier on medical costs, adjusted for accident type and fault.
What factors can increase my car accident settlement in Florida?
Higher medical bills, severe injuries, and lower fault percentage can increase settlements. Meeting Florida's serious-injury threshold allows claims for pain and suffering.
How does Florida's fault rule affect my settlement?
Your settlement is reduced by your share of fault. If you're 51% or more at fault, you recover nothing under Florida's modified comparative fault rule.
What is the statute of limitations for car accident claims in Florida?
You have 2 years from the date of injury to file a personal injury claim in Florida.
Should I accept the insurance company's first settlement offer?
Initial offers are often low. Consider consulting with a professional to evaluate if it reflects your actual damages and fault percentage.
How long do car accident settlements typically take in Sanford?
The timeline varies based on case complexity, severity of injuries, and negotiations. Simple cases may resolve in months; complex ones can take longer.
What medical documentation is important for my car accident claim?
Medical records, treatment plans, and bills are crucial. They substantiate injury severity and costs, impacting your settlement calculation.
How do lawyer fees affect my car accident settlement in Florida?
Contingency fees, typically 33% to 40%, are deducted from your settlement. Free consultations are common, allowing you to discuss potential fees upfront.
