My practice is focused on the related disciplines of estate planning and probate law. I understand that it is upsetting to consider the risk of dying or becoming incapacitated. However, these assets do not belong to the people who are entitled to claim them. Florida probate requires assets to be inventoried and legally distributed to protect the assets from valid creditors, heirs, and the decedent's estate. If there are creditors, all of them must follow Florida law and probate to be treated fairly and justly. Any attempt to sidestep probate is legally forbidden and may lead to further legal repercussions for the beneficiaries. There are three types of Florida Probate. Probate administration involves collecting estate assets (real estate, personal property, or both), settling the estate's valid debts, and giving the heirs what is left. The probate process does not allow the Will, although it may be modified to avoid it. All individuals with property in the state of Florida must have legal counsel to handle the probate law. If the estate does not exceed $75k, the summary administration may be used, but it is limited. If the estate is over $75k, the formal administration is used. If the estate is in another state, ancillary administration is used by the deceased person.
