About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Georgia law.

Georgia rules this calculator applies

Fault rule
Modified comparative fault (50% bar). Your payout drops by your share of fault. If you were 50% or more at fault, you recover nothing.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in Georgia. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about Georgia law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

10 questions
How much is my personal injury case worth in Albany, GA?
The calculator estimates your case value based on medical bills, lost wages, pain and suffering, and your fault percentage. Results vary widely.
How is pain and suffering calculated in Georgia?
Pain and suffering are estimated using a multiplier of 1.5 to 5 on medical costs, depending on injury severity.
Does Georgia's fault rule affect my settlement?
Yes, under Georgia's modified comparative fault rule, your settlement is reduced by your fault percentage. 50% or more fault means no recovery.
What raises or lowers a settlement amount?
Factors include injury severity, medical costs, lost wages, pain and suffering, and your fault percentage.
How accurate is a personal injury settlement calculator?
Calculators provide estimates based on inputs. Actual settlements depend on negotiations and specific case details.
What is the deadline for filing a personal injury claim in Georgia?
You have 2 years from the injury date to file a claim. Different rules apply for government claims and other cases.
Should I accept the insurer's first settlement offer?
It's common to negotiate. Initial offers may be lower than the case's potential value. Consider consulting a professional.
How long do personal injury settlements take in Albany?
Settlement timelines vary; they can take months to years depending on case complexity and negotiations.
What medical documentation is important for a settlement?
Keep records of all medical treatments, bills, and doctor reports. Detailed documentation supports your claim.
How do lawyer fees affect my net settlement in Georgia?
Lawyers typically take 33% to 40% of the settlement as a contingency fee, which affects your net amount.
