This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Kansas law. In Kansas, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.
Kansas is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 85% of your lost income, up to $4,500, whoever caused the crash.
You can claim pain and suffering from the at-fault driver only if your injury includes a fracture of a weight-bearing bone, a compound or displaced fracture, a permanent injury, permanent disfigurement, loss of a body member, or death, or your medical bills exceed $2,000. Financial losses above your PIP limit can still be claimed.
