About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Kentucky law. In Kentucky, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Kentucky rules this calculator applies

Fault rule
Pure comparative fault. Your payout drops by your share of fault, but you can still recover even if you were mostly at fault.
Deadline to file
You generally have one year from the date of the injury to file a personal injury claim in Kentucky. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Kentucky

Kentucky is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 85% of your lost income, up to $10,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury includes a fracture, a permanent injury, permanent disfigurement, loss of a body member, or death, or your medical bills exceed $1,000. Financial losses above your PIP limit can still be claimed.

Kentucky drivers are covered by no-fault unless they filed a written rejection with the Department of Insurance before the accident; those who rejected it keep full rights to sue.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

9 questions
How does the Louisville car accident settlement calculator estimate my claim?
It calculates economic damages (medical bills + lost wages) and adds pain and suffering using a multiplier of 1.5 to 5, adjusted for accident type and fault.
What affects the accuracy of my car accident settlement estimate in Kentucky?
Accurate estimates depend on complete medical documentation, clear fault assessment, and verified economic losses. The calculator provides a range based on these inputs.
Can I still recover damages if I was mostly at fault in a Kentucky car accident?
Yes, under Kentucky's pure comparative fault rule, your recovery is reduced by your fault percentage, but you can still recover damages even if mostly at fault.
How long do I have to file a car accident claim in Kentucky?
You have one year from the date of injury to file a personal injury claim. Different deadlines apply for claims against government bodies and other types.
Should I accept the first settlement offer from the insurance company?
Generally, it's wise to evaluate the offer carefully and consider consulting a professional, as initial offers may not reflect full compensation for your losses.
What medical documentation is important for my car accident claim in Louisville?
Keep detailed records of all medical treatments, bills, and any diagnoses related to the accident. These documents support your claim for damages.
How do lawyer fees impact my car accident settlement in Kentucky?
Lawyers often work on contingency fees, typically 33% to 40% of the settlement. This fee is deducted from your total recovery amount.
How does Louisville's traffic pattern influence car accident settlements?
Louisville's traffic conditions can affect accident severity, influencing settlement amounts. Denser traffic may lead to more complex claims.
What is the average time to settle a car accident claim in Kentucky?
Settlement times vary widely, often taking months. Factors include claim complexity, negotiation length, and court schedules if litigation is involved.
