About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Massachusetts law. In Massachusetts, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Massachusetts is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 75% of your lost income, up to $8,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury includes a fracture, permanent and serious disfigurement, loss of sight or hearing, loss of a body member, or death, or your medical bills exceed $2,000. Financial losses above your PIP limit can still be claimed.
