About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Massachusetts law. In Massachusetts, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Massachusetts rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in Massachusetts. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Massachusetts

Massachusetts is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 75% of your lost income, up to $8,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury includes a fracture, permanent and serious disfigurement, loss of sight or hearing, loss of a body member, or death, or your medical bills exceed $2,000. Financial losses above your PIP limit can still be claimed.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

10 questions
How is my car accident settlement calculated in Randolph?
The calculator estimates economic damages (medical bills, lost wages) and pain and suffering, adjusted for accident type and fault under Massachusetts law.
What raises or lowers a car accident settlement in Massachusetts?
Factors include the severity of injuries, medical costs, lost income, and your share of fault. Severe injuries and lower fault increase potential settlements.
How is pain and suffering calculated in Massachusetts?
Pain and suffering is estimated using a multiplier (1.5 to 5) on medical costs, depending on injury severity. Massachusetts law requires specific injury criteria to claim.
Does Massachusetts's fault rule affect my settlement?
Yes, your payout decreases by your fault percentage. If you're 51% or more at fault, you recover nothing under Massachusetts's modified comparative fault rule.
What is the deadline for filing a car accident claim in Massachusetts?
You generally have 3 years from the injury date to file a personal injury claim in Massachusetts.
Should I accept the insurance company's first settlement offer?
It's often advisable to review the offer carefully, as initial offers may be lower than what you might receive with negotiation or legal advice.
How long does it take to settle a car accident claim in Randolph?
Settlement times vary based on case complexity, negotiation length, and court schedules. Simple cases may resolve in months; complex ones take longer.
What medical documentation is important for a car accident claim?
Keep detailed records of all medical treatments, bills, and diagnoses. These documents support your claim for economic and non-economic damages.
How do lawyer fees affect my car accident settlement?
Lawyers typically work on contingency, taking 33% to 40% of the settlement. This fee is deducted from your total award.
What is specific to Randolph in car accident claims?
Local factors like traffic patterns and court schedules may influence your claim's timing and complexity, but settlement calculations follow Massachusetts law.
