DUI (Driving Under the Influence) Driving under the influence happens when the volume of alcohol in your blood exceeds the legal limit of 0.8%. Before an arrest is made, the officer will ask you to complete a series of field sobriety tests. You will fail these tests if you are drunk and cannot pass them properly. When this happens, the officer will take you into custody. All these offenses can lead to immediate administrative actions that are unrelated to the criminal court and its judgement. The police will take your driving license and offer you temporary paper permits. These paper permits will be valid for forty-five days, and you will be charged with a directive to attend a hearing. A hearing will be held at Maryland Motor Vehicle Administration, which will determine if the administrative sanctions such as suspension of your driving license and assessment of points to your license will be increased, reduced, or canceled.
