Injury claim costs by body part

What does an injury cost by body part?

Pick how serious the injury is. Each point shows the average medical bill for that body part at that severity; bigger point = costlier injury. Tap a point to compare it with the average workers’ comp claim for the same body part, which also pays lost wages. Then run the calculator for your own number.

About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Michigan law. In Michigan, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Michigan rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in Michigan. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Michigan

Michigan is a no-fault state. After a car accident, your own personal injury protection (PIP) covers your medical bills with no dollar cap by default, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets Michigan's serious-injury threshold: a serious impairment of a body function, permanent serious disfigurement, or death. Financial losses above your PIP limit can still be claimed.

Michigan drivers can choose a lower PIP limit when they buy coverage; unlimited medical coverage is the default if no choice was made.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

10 questions
How is a car accident settlement calculated in Dearborn Heights?
Settlements estimate economic damages plus pain and suffering, adjusted for fault. Pain and suffering use a multiplier on medical costs, 1.5 to 5, based on injury severity.
What affects the accuracy of a settlement calculator?
Accuracy depends on accurate input of medical costs, lost wages, and fault percentage. Real settlements consider more factors, including insurer negotiations.
How does Michigan's fault rule impact my settlement?
Your payout reduces by your fault share. If you're 51% or more at fault, you recover nothing.
What is the statute of limitations for car accident claims in Michigan?
You have 3 years from the injury date to file a personal injury claim in Michigan.
Should I accept the first settlement offer from an insurer?
Insurers often start with low offers. Consider consulting a lawyer before accepting to ensure fair compensation.
How long do car accident settlements typically take?
Settlement times vary widely, from weeks to years, depending on case complexity and negotiations.
What medical documentation is important for a car accident claim?
Keep all medical records, bills, and treatment plans. Accurate documentation supports your claim for damages.
How do lawyer fees affect my settlement amount?
Lawyers typically charge 33% to 40% of the settlement as a contingency fee, affecting your net payout.
What does PIP cover in Michigan car accidents?
PIP covers medical bills with no cap by default, regardless of fault. It doesn't cover pain and suffering.
When can I sue the at-fault driver in Michigan?
You can sue if injuries meet the serious-injury threshold: serious impairment, permanent disfigurement, or death.
