About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Michigan law. In Michigan, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Michigan rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in Michigan. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Michigan

Michigan is a no-fault state. After a car accident, your own personal injury protection (PIP) covers your medical bills with no dollar cap by default, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets Michigan's serious-injury threshold: a serious impairment of a body function, permanent serious disfigurement, or death. Financial losses above your PIP limit can still be claimed.

Michigan drivers can choose a lower PIP limit when they buy coverage; unlimited medical coverage is the default if no choice was made.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

9 questions
How is the car accident settlement calculated in Eastpointe?
The calculator estimates settlements by adding economic damages and applying a pain and suffering multiplier, adjusted for accident type and fault under Michigan law.
What factors can increase my car accident settlement in Michigan?
Higher medical costs, severe injuries, and lower fault percentages can increase your settlement. Pain and suffering are also considered if injuries meet Michigan's serious-injury threshold.
Does Michigan's no-fault law affect my settlement?
Yes, your own PIP covers medical bills regardless of fault. Pain and suffering claims require meeting the serious-injury threshold.
What is the statute of limitations for car accident claims in Michigan?
You have 3 years from the injury date to file a personal injury claim in Michigan. Different rules apply for claims against government bodies.
Should I accept the insurance company's first offer?
It's often advisable to evaluate the offer carefully. Initial offers may not reflect the full value of your claim, including pain and suffering.
How long do car accident settlements take in Eastpointe?
Settlement timelines vary, often taking months. Factors include case complexity, injury severity, and negotiation processes.
What medical documentation is important for my claim?
Medical records, bills, and treatment plans are crucial for substantiating your economic damages and injury severity.
How do lawyer fees affect my settlement amount?
Lawyers typically charge 33% to 40% of the settlement as a contingency fee, which is deducted from your payout.
What makes Eastpointe unique for car accident claims?
Local traffic patterns and Eastpointe's cost of living can influence economic damage calculations.
