About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Michigan law. In Michigan, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Michigan rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in Michigan. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Michigan

Michigan is a no-fault state. After a car accident, your own personal injury protection (PIP) covers your medical bills with no dollar cap by default, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets Michigan's serious-injury threshold: a serious impairment of a body function, permanent serious disfigurement, or death. Financial losses above your PIP limit can still be claimed.

Michigan drivers can choose a lower PIP limit when they buy coverage; unlimited medical coverage is the default if no choice was made.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

10 questions
How is my car accident settlement estimated in Pontiac?
The calculator uses medical costs, lost wages, and a pain and suffering multiplier (1.5 to 5), adjusted for accident type and fault under Michigan law.
What affects my settlement amount in Michigan?
Fault percentage, injury severity, and medical documentation impact settlements. Michigan's modified comparative fault rule reduces payouts by your fault share.
How does Michigan's no-fault insurance work?
No-fault PIP covers medical bills regardless of fault. To sue for pain and suffering, injuries must meet Michigan's serious-injury threshold.
Should I accept the first insurance offer after a car accident?
It's generally wise to evaluate offers carefully. Initial offers may not reflect full damages, especially for pain and suffering or long-term impacts.
What is the deadline to file a car accident claim in Michigan?
You have 3 years from the injury date to file a personal injury claim. Deadlines differ for claims against government bodies and other cases.
How long do car accident settlements take in Michigan?
Settlement time varies widely. Factors include case complexity, injury severity, and negotiation duration. Some cases resolve in months, others take longer.
What medical documents are important for my claim?
Medical records, bills, and treatment plans are crucial. They substantiate injury severity and costs, influencing settlement calculations.
How are pain and suffering damages calculated in Michigan?
The calculator uses a multiplier (1.5 to 5) on medical costs, reflecting injury severity. Michigan requires meeting a serious-injury threshold to claim these.
Do lawyer fees affect my net settlement in Pontiac?
Yes, contingency fees (typically 33%-40%) are deducted from your settlement. Free consultations are common to discuss potential outcomes.
What is unique about car accident claims in Pontiac, MI?
Pontiac's local courts handle claims, and local traffic patterns can influence accident scenarios. Michigan's no-fault laws apply statewide.
