About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Michigan law.

Michigan rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in Michigan. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about Michigan law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

9 questions
How much is my personal injury case worth in Saginaw?
The calculator estimates based on medical bills, lost wages, and pain and suffering. Your fault percentage under Michigan law reduces the amount.
How is pain and suffering calculated in Michigan?
Pain and suffering are estimated using a multiplier of 1.5 to 5 on medical costs, adjusted for accident type and severity.
Does Michigan's fault rule affect my settlement?
Yes, under Michigan's modified comparative fault rule, your payout decreases by your fault percentage. If you're 51% or more at fault, you recover nothing.
What raises or lowers a personal injury settlement?
Factors include medical costs, lost wages, accident severity, and your fault percentage. Strong documentation can increase settlement value.
Should I accept the first offer from an insurer?
Consider consulting a lawyer before accepting an insurer's first offer, as initial offers may be lower than your case's potential value.
How long do I have to file a personal injury claim in Michigan?
You generally have 3 years from the injury date to file a personal injury claim in Michigan.
What medical documentation is important for my case?
Medical bills, treatment records, and doctor's notes are crucial for calculating damages and supporting your claim.
How do lawyer fees affect my net settlement amount?
Lawyer fees, often 33% to 40% of the settlement, reduce your net amount. Many lawyers offer free consultations.
What is specific to Saginaw in personal injury cases?
Local factors like traffic patterns and cost of living may influence settlement considerations, but legal rules follow Michigan state law.
