What does an injury cost by body part?

Pick how serious the injury is. Each point shows the average medical bill for that body part at that severity; bigger point = costlier injury. About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Minnesota law. In Minnesota, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Minnesota rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 6 years from the date of the injury to file a personal injury claim in Minnesota. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Minnesota

Minnesota is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 85% of your lost income, up to $20,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury includes a permanent injury, permanent disfigurement, a disability lasting 60 days or more, or death, or your medical bills exceed $4,000. Financial losses above your PIP limit can still be claimed.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

9 questions
How does the Bloomington car accident settlement calculator work?
The calculator estimates economic damages and applies a multiplier for pain and suffering, adjusted for accident type and fault. It uses Minnesota's modified comparative fault rule.
How is pain and suffering calculated in Minnesota car accidents?
Pain and suffering are estimated using a multiplier (1.5 to 5) on medical costs, based on injury severity. Permanent injuries or high medical bills may increase this.
What is the statute of limitations for car accident claims in Minnesota?
You have 6 years from the injury date to file a personal injury claim in Minnesota. Claims against government bodies require earlier notice.
Should I accept the insurance company's first offer after a car accident?
It's often wise to evaluate the offer carefully. Initial offers may not reflect full damages. Consider consulting with a professional for guidance.
How does Minnesota's modified comparative fault rule impact my settlement?
Your settlement is reduced by your fault percentage. If you're 51% or more at fault, you recover nothing under Minnesota law.
What documentation is important for a car accident claim in Bloomington?
Medical records, bills, and proof of lost wages are crucial. Ensure all injuries and treatments are documented to support your claim.
How long does it typically take to settle a car accident claim in Minnesota?
Settlement times vary. Simple claims may resolve in months, while complex cases can take years, especially if litigation is involved.
How do lawyer fees affect my car accident settlement in Minnesota?
Lawyer fees, often 33% to 40% on contingency, are deducted from your settlement. Free consultations are common to discuss potential claims.
What makes Bloomington car accident claims unique?
Local factors like traffic patterns and cost of living can influence settlements. Bloomington's proximity to major highways may affect accident frequency.
