About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Minnesota law. In Minnesota, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

Minnesota rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 6 years from the date of the injury to file a personal injury claim in Minnesota. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in Minnesota

Minnesota is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 85% of your lost income, up to $20,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury includes a permanent injury, permanent disfigurement, a disability lasting 60 days or more, or death, or your medical bills exceed $4,000. Financial losses above your PIP limit can still be claimed.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.
