In North Carolina, for example, many potential franchisors must register their franchise as a business opportunity with the North Carolina Secretary of State. N.C.G.S. §66-97 mandates this, requiring the franchisor to file two copies of a franchise disclosure statement and pay a $250 registration fee. One exception is franchisors who have secured a federal trademark for the franchise. If the franchisor’s federal trademark is registered with the United States Patent and Trademark Office, they can bypass North Carolina's registration requirement.
