About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under North Carolina law.

North Carolina rules this calculator applies

Fault rule
Contributory negligence. One of the strictest rules in the country: if you were even 1% at fault, you may recover nothing. A lawyer matters more here than anywhere.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in North Carolina. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about North Carolina law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

9 questions
How much is my personal injury case worth in Jacksonville, NC?
Our calculator estimates your settlement by adding economic damages and multiplying medical costs by a pain and suffering factor. North Carolina's contributory negligence rule can impact your claim significantly.
How is pain and suffering calculated in North Carolina?
Pain and suffering are estimated using a multiplier of 1.5 to 5 on medical costs, depending on injury severity. This is added to economic damages for a total estimate.
Does North Carolina's fault rule affect my settlement?
Yes, North Carolina's contributory negligence rule means if you're even 1% at fault, you may recover nothing. This makes legal advice crucial.
Should I accept the insurance company's first settlement offer?
Insurers often offer low initial settlements. It's wise to evaluate the offer against your calculated estimate and seek legal advice before accepting.
How long do personal injury settlements take in Jacksonville, NC?
Settlement timelines vary widely. Factors include case complexity, negotiation length, and court schedules. Consulting a lawyer can provide a clearer timeline.
What medical documentation is important for my claim?
Keep records of all medical visits, treatments, and expenses. Detailed documentation supports your claim and helps calculate accurate economic damages.
How do lawyer fees affect my settlement amount?
Lawyers typically work on contingency, taking 33% to 40% of the settlement. This fee is deducted from the total amount recovered.
What factors can increase my settlement amount?
Higher medical expenses, severe injuries, and clear liability can increase settlements. Accurate documentation and legal representation are key.
Are there specific factors in Jacksonville, NC, affecting settlements?
Local factors like traffic patterns and court schedules can influence case timelines but not settlement amounts directly. Legal advice can clarify local nuances.
