About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under North Carolina law.

North Carolina rules this calculator applies

Fault rule
Contributory negligence. One of the strictest rules in the country: if you were even 1% at fault, you may recover nothing. A lawyer matters more here than anywhere.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in North Carolina. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about North Carolina law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

9 questions
How does the personal injury settlement calculator estimate my case value?
The calculator uses your medical costs, lost wages, and a pain and suffering multiplier (1.5 to 5) adjusted for accident type, minus your fault percentage.
Is the settlement estimate accurate for Leland, NC?
The estimate provides a general range based on typical factors in Leland. Actual settlements can vary based on specific details and negotiations.
How does North Carolina's contributory negligence affect my settlement?
If you're even 1% at fault, you may recover nothing due to North Carolina's strict contributory negligence rule.
What factors can increase my settlement amount?
Higher medical bills, lost wages, and severe injuries can increase your settlement. Pain and suffering are also considered using a multiplier.
Should I accept the insurance company's first offer?
It's often advisable to review the offer carefully; initial offers may be lower than what you could negotiate or deserve.
How long does it usually take to settle a personal injury claim?
Settlement times vary; they can take weeks to months depending on case complexity and negotiations.
What medical documentation is important for my claim?
Keep records of all medical treatments, bills, and doctor's notes as they are crucial for calculating damages.
How do lawyer fees impact my final settlement amount?
Lawyer fees, often 33% to 40% of the settlement, are deducted from your total recovery, affecting your net amount.
Are there any specific factors in Leland that affect settlements?
Local factors like traffic patterns and cost of living may influence settlement amounts, but specifics vary by case.
