Where to begin? I suppose with the fact that in all of my years this was the most bungling and incompetent/professionally negligent law firm I have ever used. I was in an automobile accident nearly four months ago I and I retained Riddle to represent me. From the start communication was slow to then…

I spoke with Debbie who was very compassionate and understanding. It's difficult digging up skeletons that have been buried in the closet. At this point, I feel very comfortable with Riddle & Brantley. My Father was a fighter pilot in WW2 who flew 223 combat missions. He struggled with Parkinson's d…

How this Raleigh long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any SSDI offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.

North Carolina rules this calculator applies

Deadline to act
For an ERISA employer plan, file your internal appeal within 180 days of the denial letter; you cannot sue until it is decided.
Discount rate
Future benefits are discounted at 3%, a common buyout assumption.
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
SSDI offset
Most employer plans reduce your LTD benefit by any Social Security Disability (SSDI) you receive (about $1,630 a month on average in 2026).
Tax
If your employer paid the premiums, or you paid them with pre-tax dollars, LTD benefits and settlements are taxable income. If you paid with after-tax money, they are generally not. Get tax advice before you sign.
ERISA plans
Most employer plans are governed by ERISA: you must file an internal appeal within 180 days of the denial before you can sue, the insurer usually has 45 days (plus one 45-day extension) to decide, and the case is then heard by a judge on the written record. ERISA allows back benefits, reinstatement and attorney fees, but no jury and no punitive or emotional-distress damages. Individual, government and church plans fall outside ERISA, so state law applies: you can usually sue in state court, and bad-faith damages may be available.

General information about North Carolina disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

8 questions
How does the long-term disability settlement calculator work?
The calculator estimates back pay, future benefits to age 65, their present value, and a typical lump-sum range based on your claim status, policy type, and offsets.
What is a long-term disability buyout?
A buyout is a lump-sum offer to settle your future disability benefits. Typical offers range from 30-75% of the present value, depending on claim status.
Why are LTD settlements below full value?
Settlements are lower to account for the risk and uncertainty of future payments and to incentivize insurers to settle claims without prolonged litigation.
What should I do if my LTD claim is denied in North Carolina?
Under ERISA, you must file an internal appeal within 180 days of denial. Non-ERISA plans might allow you to sue in state court for bad-faith damages.
How does the SSDI offset affect my LTD benefits?
Most LTD policies reduce your benefit by any SSDI received. This offset affects the calculation of your back pay and future benefits.
Are LTD settlements taxable in Raleigh?
If your employer paid the premiums or you used pre-tax dollars, settlements are taxable. If paid with after-tax money, they are generally not. Consult a tax advisor.
What is the difference between 'own occupation' and 'any occupation'?
Most policies switch from 'own occupation' to 'any occupation' after 24 months, affecting eligibility for continued benefits based on your ability to work in any job.
How accurate is the LTD settlement calculator?
The calculator provides estimates based on typical ranges and inputs. Actual settlements vary by insurer and individual circumstances.
