About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under North Dakota law.

North Dakota rules this calculator applies

Fault rule
Modified comparative fault (50% bar). Your payout drops by your share of fault. If you were 50% or more at fault, you recover nothing.
Deadline to file
You generally have 6 years from the date of the injury to file a personal injury claim in North Dakota. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about North Dakota law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

9 questions
How does the Bismarck personal injury settlement calculator estimate my case value?
The calculator estimates by adding economic damages and multiplying medical costs by 1.5 to 5 for pain and suffering, adjusted for accident type and fault.
What factors can increase my settlement in North Dakota?
Higher medical bills, lost wages, and severe injuries can increase your settlement. Lower fault percentages under North Dakota's modified comparative fault rule also help.
How does North Dakota's fault rule affect my settlement?
Your settlement decreases by your fault percentage. If you're 50% or more at fault, you recover nothing under North Dakota's modified comparative fault rule.
What is the statute of limitations for personal injury claims in North Dakota?
You have 6 years from the injury date to file a general negligence claim in North Dakota. Other claims may have different deadlines.
Should I accept the insurance company's first settlement offer?
It's wise to evaluate the offer carefully. Initial offers may be lower than what you could receive. Consider consulting a lawyer for guidance.
How long do personal injury settlements take in Bismarck?
Settlement times vary based on case complexity and negotiation length. Some cases resolve in months, others take years, especially if they go to court.
What medical documentation is important for my settlement?
Keep all medical records, bills, and treatment notes. These documents support your claim for economic damages and pain and suffering.
How do lawyer fees impact my final settlement amount?
Lawyers typically charge 33% to 40% of the settlement as a contingency fee. This fee reduces your net amount but can be crucial for maximizing your claim.
What is unique about personal injury claims in Bismarck?
Bismarck's local courts and cost of living may influence settlement amounts. Consult local legal resources for city-specific insights.
