About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under New Jersey law. In New Jersey, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

New Jersey rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in New Jersey. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in New Jersey

New Jersey is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills, up to $15,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets New Jersey's serious-injury threshold: a displaced fracture, a permanent injury, significant disfigurement or scarring, loss of a body part, or death. Financial losses above your PIP limit can still be claimed.

This applies to the Limitation on Lawsuit option, which is the default if no choice was made. Drivers who chose No Limitation can claim pain and suffering after any injury.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

10 questions
How does the car accident settlement calculator work?
It estimates economic damages (medical bills, lost wages) and pain and suffering using a multiplier of 1.5 to 5 on medical costs, adjusted for fault.
What factors affect my car accident settlement in East Orange?
Factors include medical bills, lost wages, pain and suffering, your share of fault, and whether your injury meets New Jersey's serious-injury threshold.
How is pain and suffering calculated in New Jersey?
It's estimated using a multiplier (1.5 to 5) on medical costs, based on injury severity. New Jersey's threshold must be met for claims.

You have 2 years from the injury date to file a personal injury claim. Different deadlines apply for government claims and other cases.

How do lawyer fees impact my car accident settlement?
Lawyers often work on contingency, taking 33% to 40% of the settlement. This affects your net amount received.
What is unique about car accident claims in East Orange?
East Orange's traffic patterns and local court schedules can influence claim timelines. Consult local resources for specific insights.
