This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under New Jersey law. In New Jersey, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.
New Jersey is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills, up to $15,000, whoever caused the crash.
You can claim pain and suffering from the at-fault driver only if your injury meets New Jersey's serious-injury threshold: a displaced fracture, a permanent injury, significant disfigurement or scarring, loss of a body part, or death. Financial losses above your PIP limit can still be claimed.
This applies to the Limitation on Lawsuit option, which is the default if no choice was made. Drivers who chose No Limitation can claim pain and suffering after any injury.
