What does an injury cost by body part?

Pick how serious the injury is. Each point shows the average medical bill for that body part at that severity; bigger point = costlier injury. Tap a point to compare it with the average workers’ comp claim for the same body part, which also pays lost wages. Then run the calculator for your own number.

About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under New Jersey law. In New Jersey, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

New Jersey rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in New Jersey. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in New Jersey

New Jersey is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills, up to $15,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets New Jersey's serious-injury threshold: a displaced fracture, a permanent injury, significant disfigurement or scarring, loss of a body part, or death. Financial losses above your PIP limit can still be claimed.

This applies to the Limitation on Lawsuit option, which is the default if no choice was made. Drivers who chose No Limitation can claim pain and suffering after any injury.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

10 questions
How is my car accident settlement calculated in Princeton?
The calculator estimates settlements using medical bills, lost wages, and pain and suffering, adjusted for accident type and fault under New Jersey law.
What affects the accuracy of the settlement estimate?
Accuracy depends on the completeness of your input data and the complexity of your case. The calculator provides a range, not a precise figure.
How does New Jersey's fault rule impact my settlement?
Your settlement decreases by your fault percentage. If you are 51% or more at fault, you receive nothing.
When can I sue for pain and suffering in New Jersey?
You can sue if your injury meets New Jersey's serious-injury threshold, like a displaced fracture or permanent injury.
Should I accept the insurance company's first offer?
Generally, the first offer is lower than what might be negotiated. Consider seeking a professional opinion before accepting.
What is the statute of limitations for car accidents in New Jersey?
You have 2 years from the injury date to file a general negligence claim. Different rules apply for government claims.
How long does it take to settle a car accident claim?
Settlement times vary widely based on case complexity, negotiation duration, and court schedules if litigation occurs.
What medical documentation is important for my claim?
Keep detailed records of medical treatments, bills, and doctor reports. These documents support your claim for damages.
How do lawyer fees affect my net settlement amount?
Lawyer fees, often 33% to 40% of the settlement, are deducted from your total award, impacting the net amount you receive.
Is there anything specific to Princeton that affects settlements?
Local factors like traffic patterns and cost of living may influence settlement amounts, but they vary case by case.
