About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under New York law. In New York, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

New York rules this calculator applies

Fault rule
Pure comparative fault. Your payout drops by your share of fault, but you can still recover even if you were mostly at fault.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in New York. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in New York

New York is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 80% of your lost income, up to $50,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets New York's serious-injury threshold: a fracture, significant disfigurement, permanent loss or limitation of a body organ, member or function, significant limitation of a body function, or death. Financial losses above your PIP limit can still be claimed.

Since May 26, 2026, a driver who is more than 50% at fault for a car accident in New York can no longer recover pain and suffering, only a reduced share of their financial losses.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

10 questions
How does the Auburn car accident settlement calculator work?
It estimates economic damages (medical bills, lost wages) and pain and suffering using a multiplier, adjusted for accident type and fault under New York law.
What affects my car accident settlement in New York?
Settlement amounts depend on medical costs, lost wages, pain and suffering, and your share of fault. New York's pure comparative fault rule reduces payouts by your fault percentage.
How is pain and suffering calculated in Auburn?
Pain and suffering are estimated using a multiplier of 1.5 to 5 on medical costs, based on injury severity and accident type.
Can I sue the other driver in a no-fault state like New York?
You can sue for pain and suffering if your injury meets New York's serious-injury threshold, or for financial losses above PIP limits.
What is the statute of limitations for car accidents in New York?
You have 3 years from the injury date to file a personal injury claim in New York. Different deadlines apply for claims against government bodies.
Should I accept the insurance company's first settlement offer?
Consider if the offer covers all damages, including pain and suffering, and consult with a professional if unsure. First offers are often negotiable.
What documentation is important for my settlement?
Medical records, bills, proof of lost wages, and any evidence of pain and suffering are crucial for determining settlement amounts.
How do lawyer fees affect my settlement in Auburn?
Lawyer fees, often 33% to 40% on contingency, are deducted from your settlement, impacting the net amount you receive.
How long do car accident settlements take in New York?
Settlement times vary widely, often taking months to resolve, depending on case complexity and negotiation process.
Does Auburn's traffic pattern affect my settlement?
While traffic patterns can influence accident likelihood, settlements are based on damages and fault, not local traffic conditions.
