This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under New York law. In New York, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.
New York is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 80% of your lost income, up to $50,000, whoever caused the crash.
You can claim pain and suffering from the at-fault driver only if your injury meets New York's serious-injury threshold: a fracture, significant disfigurement, permanent loss or limitation of a body organ, member or function, significant limitation of a body function, or death. Financial losses above your PIP limit can still be claimed.
Since May 26, 2026, a driver who is more than 50% at fault for a car accident in New York can no longer recover pain and suffering, only a reduced share of their financial losses.
