What does an injury cost by body part?

Pick how serious the injury is. Each point shows the average medical bill for that body part at that severity; bigger point = costlier injury. Tap a point to compare it with the average workers’ comp claim for the same body part, which also pays lost wages. Then run the calculator for your own number.

About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under New York law. In New York, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

New York rules this calculator applies

Fault rule
Pure comparative fault. Your payout drops by your share of fault, but you can still recover even if you were mostly at fault.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in New York. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in New York

New York is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 80% of your lost income, up to $50,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets New York's serious-injury threshold: a fracture, significant disfigurement, permanent loss or limitation of a body organ, member or function, significant limitation of a body function, or death. Financial losses above your PIP limit can still be claimed.

Since May 26, 2026, a driver who is more than 50% at fault for a car accident in New York can no longer recover pain and suffering, only a reduced share of their financial losses.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

Frequently asked questions

9 questions
How does the Fishkill car accident settlement calculator estimate my claim?
The calculator estimates using medical bills, lost wages, and a pain and suffering multiplier from 1.5 to 5, adjusted for accident type and fault percentage.
What factors can increase my car accident settlement in New York?
Higher medical costs, severe injuries, and lower fault percentage can increase settlements. Meeting New York's serious-injury threshold allows claims for pain and suffering.
How does my share of fault affect my settlement in Fishkill?
Under New York's pure comparative fault rule, your settlement reduces by your fault percentage but you can still recover even if mostly at fault.
What is the statute of limitations for car accident claims in New York?
You have 3 years from the injury date to file a personal injury claim. Different deadlines apply for claims against government bodies or medical malpractice.
Should I accept the insurance company's first settlement offer?
It's often advisable to evaluate the offer carefully, as initial offers may be lower than what you could negotiate with further evidence or legal advice.
How long does it typically take to settle a car accident claim in New York?
Settlement times vary widely, often taking months to over a year, depending on case complexity, injury severity, and negotiation or litigation time.
What medical documentation is important for my settlement?
Keep detailed records of medical treatments, bills, and any ongoing care needs to support your claim for economic and non-economic damages.
How do lawyer fees impact my net settlement amount?
Contingency fees, typically 33% to 40%, are deducted from your settlement, affecting the final amount you receive.
Are there any specific factors in Fishkill that might affect my settlement?
Local traffic patterns and cost of living may influence settlement evaluations, but specifics depend on individual case details.
