Injury claim costs by body part

What does an injury cost by body part?

Pick how serious the injury is. Each point shows the average medical bill for that body part at that severity; bigger point = costlier injury. Tap a point to compare it with the average workers’ comp claim for the same body part, which also pays lost wages. Then run the calculator for your own number.

About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under New York law. In New York, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.

New York rules this calculator applies

Fault rule
Pure comparative fault. Your payout drops by your share of fault, but you can still recover even if you were mostly at fault.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in New York. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.
No-fault
Yes. Your own PIP pays first; see below.

No-fault insurance in New York

New York is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills and 80% of your lost income, up to $50,000, whoever caused the crash.

You can claim pain and suffering from the at-fault driver only if your injury meets New York's serious-injury threshold: a fracture, significant disfigurement, permanent loss or limitation of a body organ, member or function, significant limitation of a body function, or death. Financial losses above your PIP limit can still be claimed.

Since May 26, 2026, a driver who is more than 50% at fault for a car accident in New York can no longer recover pain and suffering, only a reduced share of their financial losses.

Motorcycle riders are generally outside PIP and follow the ordinary fault rules. Choose Motorcycle Accident in the calculator above to see that estimate.

10 questions
How does the car accident settlement calculator work?
It estimates economic damages and pain and suffering using a multiplier on medical costs, adjusted for accident type and fault share under New York law.
What factors affect my car accident settlement in Queensbury?
Your settlement depends on medical costs, lost wages, pain and suffering, your fault share, and whether your injury meets New York's serious-injury threshold.
How is pain and suffering calculated in New York?
Pain and suffering are estimated using a multiplier of 1.5 to 5 on medical costs, based on injury severity and accident type.
Can I still recover damages if I'm mostly at fault in New York?
Yes, under New York's pure comparative fault rule, you can recover damages even if you're mostly at fault, but your payout decreases by your fault percentage.
What is the statute of limitations for car accident claims in New York?
You have 3 years from the date of injury to file a personal injury claim in New York. Different rules apply for government claims and other types.
Should I accept the insurance company's first settlement offer?

How long do car accident settlements take in New York?
Settlement timelines vary widely, often taking months to over a year, depending on case complexity and negotiation dynamics.
What medical documentation is important for my claim?
Keep detailed records of all medical treatments, bills, and doctor's notes, as they are crucial for calculating damages and verifying injury severity.

Lawyer fees, typically 33% to 40% of your settlement, are usually deducted from your payout. Free consultations are common to discuss your case.
What makes Queensbury unique in car accident claims?
Local factors like traffic patterns and cost of living can subtly influence claims, but New York state laws primarily govern settlement calculations.
