This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Pennsylvania law. In Pennsylvania, a no-fault state, it also separates what your own PIP insurance pays from what you can claim from the other driver.
Pennsylvania is a no-fault state. After a car accident, your own personal injury protection (PIP) pays your medical bills, up to $5,000, whoever caused the crash.
Pennsylvania drivers choose full tort or limited tort. Full tort, the default if you did not sign for limited tort, lets you claim pain and suffering after any injury. Limited tort allows it only for death, serious impairment of a body function, or permanent serious disfigurement.
