Ruhmann Law Firm provided a great experience. I will not go into details about my accident. ALEX, their paralegal/legal assistant was by far the most valuable element of Ruhmann Law Firm. He was a professional and dedicated employee from the beginning. His professionalism and dedication was evident from the beginning. He worked tirelessly to resolve my case. This is because both I've retained lawyers before and have been in Law Offices, but I've never witnessed such hard work and dedication. Ruhmann should be able to appreciate the value of Alex and their team. This being said, I would highly recommend the Law Firm. Alex, thank you so much! !

I tried to present my case to several law firms and they told me it wasn't worth their time. Mr. Martinez took my case and stuck it out to the end with a favorable decision. I would definitely recommend the Martinez and Martinez Law Firm to any friend or family member.

How this El Paso long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any SSDI offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.

Texas rules this calculator applies

Deadline to act
For an ERISA employer plan, file your internal appeal within 180 days of the denial letter; you cannot sue until it is decided.
Discount rate
Future benefits are discounted at 3%, a common buyout assumption.
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
SSDI offset
Most employer plans reduce your LTD benefit by any Social Security Disability (SSDI) you receive (about $1,630 a month on average in 2026).
Tax
If your employer paid the premiums, or you paid them with pre-tax dollars, LTD benefits and settlements are taxable income. If you paid with after-tax money, they are generally not. Get tax advice before you sign.
ERISA plans
Most employer plans are governed by ERISA: you must file an internal appeal within 180 days of the denial before you can sue, the insurer usually has 45 days (plus one 45-day extension) to decide, and the case is then heard by a judge on the written record. ERISA allows back benefits, reinstatement and attorney fees, but no jury and no punitive or emotional-distress damages. Individual, government and church plans fall outside ERISA, so state law applies: you can usually sue in state court, and bad-faith damages may be available.

General information about Texas disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

10 questions
How does the long-term disability settlement calculator work?
The calculator estimates back pay, future benefits to age 65, their present value, and a typical lump-sum settlement range based on your claim status and policy details.
What is a long-term disability buyout?
A buyout is a lump-sum payment offered by the insurer to settle your claim. It typically ranges from 30-75% of the present value of future benefits, plus back pay.
Why are LTD settlements below full value?
Settlements are lower to account for the risk and time value of money. Insurers offer less than full value to resolve claims quickly and avoid ongoing payments.
What should I do if my LTD claim is denied in Texas?
Under ERISA, file an internal appeal within 180 days. If unsuccessful, you can sue, but the case is decided by a judge on the written record.
How does SSDI affect my LTD benefits?
Most LTD policies reduce your benefit by any SSDI received. This offset means your LTD payment decreases by the amount of SSDI you get.
Are LTD settlements taxable in Texas?
If premiums were employer-paid or pre-tax, settlements are taxable. If paid with after-tax dollars, they generally aren't. Consult a tax advisor.
What is the difference between own-occupation and any-occupation tests?
Most policies start with an 'own occupation' test, switching to 'any occupation' after 24 months, impacting eligibility for continued benefits.
How accurate is the LTD settlement estimate?
The estimate uses typical ranges and personal data to provide a general idea of potential settlement value but isn't a guarantee.
What is the deadline for appealing a denied LTD claim in El Paso?
For ERISA-governed plans, you must appeal within 180 days of denial. This is crucial for preserving your right to sue if needed.
How are back pay and future benefits calculated?
Back pay covers unpaid benefits since denial. Future benefits estimate payments until age 65, adjusted for present value.
