Texas accords with the common law principle that allows a person injured through a dog bite to recover damages from the dog’s owner or keeper if two circumstances are present: (1) the dog had previously bitten a person or shown aggression toward a human being and (2) the owner/keeper knew that the dog had done so. If these two factors exist, this creates a rebuttable presumption (i.e., an inference) that the owner knew or should have known that the dog was dangerous. If the dog owner was negligent in his care of the dog, even if the dog never bit anybody before, he may be liable (responsible) under the law for the victim’s injuries. An example of negligence occurs when a family adopts a pet dog and allows the dog to play unsupervised with the children. Under Texas law, this constitutes negligence. If the dog runs up to a child and bites him, the parents may have a lawsuit against the dog’s owner or handler for negligent handling. This is called a negligence lawsuit.
