About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Texas law.

Texas rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in Texas. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about Texas law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

10 questions
How does the Southlake personal injury settlement calculator work?
The calculator estimates your settlement by adding medical bills and lost wages, applying a pain and suffering multiplier, and adjusting for your fault under Texas law.
How accurate is a personal injury settlement calculator?
The calculator provides a general estimate. Actual settlements depend on specific case details, negotiations, and legal representation.
What factors increase a personal injury settlement in Texas?
Higher settlements can result from severe injuries, clear fault of the other party, and strong medical documentation.
How is pain and suffering calculated in Southlake?
Pain and suffering are estimated using a multiplier of 1.5 to 5 on medical costs, depending on injury severity.
How does Texas's fault rule affect my settlement?
Under Texas law, your settlement is reduced by your fault percentage. If you're 51% or more at fault, you receive nothing.
What is the deadline for filing a personal injury claim in Texas?
You generally have 2 years from the injury date to file a claim. Different rules apply for government claims.
Should I accept the insurance company's first offer?
It's often advisable to consult with a lawyer before accepting any offer, as initial offers may be lower than your claim's potential value.
How long does it take to settle a personal injury case in Texas?
Settlement times vary widely, often taking months to over a year, depending on case complexity and negotiations.
What medical documentation is important for my injury claim?
Keep detailed records of all medical treatments, bills, and doctor visits to support your claim.
How do lawyer fees affect my personal injury settlement?
Lawyer fees, often 33% to 40% of the settlement, reduce your net recovery. Most lawyers offer free consultations.
