Wilson Law, PLC was founded by Donna L. Wilson. Donna worked as a Special Education Consultant and teacher before becoming a lawyer. Due to her lifelong fascination with law and her experience working with families with special needs, Donna became a specialist in estate planning. She is able to effectively communicate with clients, making it easy for them to understand the intricacies and allowing them to take advantage of the many resources that are available in order to design their estate plans. A person who is disabled often becomes unable to take financial and personal decisions. If a disabled individual is unable to make such decisions, someone should have legal power. The person responsible for making decisions on behalf of the disabled person should have advanced written access to the individual's wishes, especially regarding medical care. A person can become disabled without any legal appointment. The family of the person must petition the court to appoint a guardian. This person may not have knowledge of the wishes or directives of the person. It can be difficult and emotionally draining to have to apply for guardianship after the death of a family member. However, it is possible to ease the burden by working with trusted attorneys in advance planning.

How this Norfolk long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any SSDI offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.

Virginia rules this calculator applies

Deadline to act
For an ERISA employer plan, file your internal appeal within 180 days of the denial letter; you cannot sue until it is decided.
Discount rate
Future benefits are discounted at 3%, a common buyout assumption.
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
SSDI offset
Most employer plans reduce your LTD benefit by any Social Security Disability (SSDI) you receive (about $1,630 a month on average in 2026).
Tax
If your employer paid the premiums, or you paid them with pre-tax dollars, LTD benefits and settlements are taxable income. If you paid with after-tax money, they are generally not. Get tax advice before you sign.
ERISA plans
Most employer plans are governed by ERISA: you must file an internal appeal within 180 days of the denial before you can sue, the insurer usually has 45 days (plus one 45-day extension) to decide, and the case is then heard by a judge on the written record. ERISA allows back benefits, reinstatement and attorney fees, but no jury and no punitive or emotional-distress damages. Individual, government and church plans fall outside ERISA, so state law applies: you can usually sue in state court, and bad-faith damages may be available.

General information about Virginia disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

8 questions
How does the long-term disability settlement calculator work?
It estimates back pay, future benefits to age 65, and a typical lump-sum settlement range based on your claim status, policy type, and other factors.
What is a long-term disability buyout?
A buyout is a lump-sum payment offered by the insurer to settle your claim, typically 30-75% of the present value of future benefits, plus back pay.
Why are LTD settlements below full value?
Settlements reflect the present value of future benefits, considering uncertainties like health and employment prospects, and typically range from 30-75%.
What should I do if my LTD claim is denied in Virginia?
Under ERISA, file an internal appeal within 180 days. If denied, you may sue in federal court. Non-ERISA plans may allow state court lawsuits.

If your employer paid premiums or you used pre-tax dollars, settlements are taxable. If paid with after-tax money, they generally aren't. Seek tax advice.
What is the difference between own-occupation and any-occupation in LTD policies?
Many policies switch from covering your own occupation to any occupation after 24 months, affecting eligibility for ongoing benefits.
How accurate is the LTD settlement calculator?
The calculator provides estimates based on typical ranges and factors like policy type and claim status but cannot guarantee specific outcomes.
What's the deadline for appealing a denied LTD claim in Norfolk?
For ERISA-governed plans, you must file an internal appeal within 180 days of denial.
