Rozek Law Offices in Milwaukee, Wisconsin represents victims of personal injury against insurance companies and large corporations. Rozek Law Offices stands out in that they limit how many clients they can represent at once. Wisconsin law firms are not known for limiting their caseload. Instead, they do the exact opposite. Rozek Law Offices has two limitations to their representation. They only represent those who have suffered serious injuries in Wisconsin. Rozek Law Offices' overall objective is to make every client happy. It is impossible to represent everyone who would appreciate their assistance. This would prevent them from giving each client their best effort and dedication. Rozek Law Offices is different from other Wisconsin personal injury attorneys because they are focused on certain types of accidents and specific injuries. Wisconsin Wrongful Death Law defines the circumstances under which a recovery may be had for the negligent acts of another that results in death. Wisconsin courts have ruled that Wisconsin Wrongful Death Recovery is statutory and not at common law. This means that the Wisconsin statutes govern the recovery for such claims.

Kim did an amazing job defending me against a frivolous legal attack. She listened and asked questions to make sure she understood the situation. She pressed for the truth, and not just part of it. My whole experience with this law firm has been professional from beginning to end. Highly recommended…

About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Wisconsin law.

Wisconsin rules this calculator applies

Fault rule
Modified comparative fault (51% bar). Your payout drops by your share of fault. If you were 51% or more at fault, you recover nothing.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in Wisconsin. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about Wisconsin law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

10 questions
How is my settlement estimate calculated in Madison?
The calculator uses medical bills, lost wages, and a pain and suffering multiplier (1.5 to 5), adjusted for accident type and your fault share under Wisconsin law.
What affects the accuracy of a settlement calculator?
Accurate input of medical costs, lost wages, and fault percentage is crucial. The calculator provides a range, not a guarantee, as each case is unique.
How is pain and suffering calculated in Wisconsin?
Pain and suffering is estimated using a multiplier on medical costs, ranging from 1.5 for minor injuries to 5 for catastrophic injuries.
Does Wisconsin's fault rule affect my settlement?
Yes, under Wisconsin's modified comparative fault rule, your settlement is reduced by your fault percentage. If you're 51% or more at fault, you recover nothing.
What is the deadline to file a personal injury claim in Wisconsin?
You have 3 years from the injury date to file a general negligence claim. Different rules apply for government claims, medical malpractice, and wrongful death.
Should I accept the insurance company's first offer?
Generally, it's wise to evaluate the offer carefully. Initial offers may not reflect the full value of your claim, especially regarding pain and suffering.
How long do personal injury settlements take in Madison?
Settlement timelines vary based on case complexity, parties involved, and court schedules. Some resolve in months, others may take years.
What medical documentation is important for my case?
Keep records of all medical treatments, bills, and doctor notes. These documents support your claim for economic damages and pain and suffering.
How do lawyer fees impact my settlement in Wisconsin?
Lawyer fees, often 33% to 40% on contingency, are deducted from your settlement. Free consultations are common to discuss potential fees.
What factors are unique to Madison for personal injury cases?
Local factors like traffic patterns and cost of living can influence case specifics. However, state laws primarily govern personal injury settlements.
