This case study highlights the importance of providing your lawyer with all the relevant evidence you have for their cases. Under no circumstance should any person hide any pieces of evidence from your lawyer. The case study involves a mediation hearing between a couple I represented. In that capacity, I was their lawyer, and they never provided me with the evidence that could have made us win the case. I had only prepared for the case using the evidence the complainant had given me, and I believed it was adequate to win the case. However, when I met the complainant before the day of the hearing, I was not convinced that the evidence that had been provided was adequate. After listening to the complainant's story, I realized that some important information had been left out, and so I requested the couple to provide me with all the evidence they had but had not given me. In the process, the couple informed me that the wife had a file at her workplace where she had kept information that the evidence I had was not met to win the case. This information was in forms of emails, letters, and other information that could have made us win the case. However, the wife had not given it to me, knowing that it was damaging. I asked her to bring it to me as we went back to my office to prepare. On arriving at the office, she went to the washrooms, and as she took long, I went to check on her. I got her trying to tear the letters and dispose of them into the toilet. She was shocked when she saw me and demanded the letters from her. She gave me all the letters she had with her, a total of 20. It was evident that they contained a lot of information that would have helped me win the case, and hence we would go with them to the court the next morning. I spent the whole night preparing the documents for court, and we went to the court the next morning. On my arrival, I noticed that the complainant had come with a file full of documents. I saw him exchanging some of the documents with his lawyer, but I didn't know whom he was meeting with. We were called to the floor, and as soon as we began the mediation hearing, I noticed that the wife's lawyer was presented with a file by the husband's lawyer, and I knew it was the file the wife was hiding from me. The lawyer picked it up and went through the letters, and after a while, he handed them over to the mediator. The mediator said that she would need some time to review the letters and until then, the hearing would have to be canceled. I was devastated and shocked by the turn of events. Immediately, I knew that the wife had gone to meet his lawyer. After the hearing was canceled, I asked the wife, and she confessed that she had met with the husband's lawyer and give him the files. She explained to me that the husband had promised to take away their child's custody if she did not provide him with the files. This incident deeply hurt me as they would have won the case if only if there was no conspiracy between the mediator, the husband, and the wife. This shows the harm that can be caused if one party hides information from their lawyer, and thus it should be avoided at all costs.
