Watermark HomerbraceThe customer filed a complaint against the respondent. She argued that the respondent's agent misrepresented the property to induce the customer to purchase it. According to the customer, the respondent's agent knew that the property had problems, but he did not disclose them. The customer also alleged that the respondent was vicariously liable for the wrongs committed by his agent because the agent was involved in persuading the customer to buy the property.
Damages sought by the customer
The customer requested a tribunal to order the respondent to refund the purchase price for the property worth $1,060,000. The customer also sought an order that the respondent pays the party's loss against the property, expenses, and the sum equal to the sales commission.
The customer requested that the tribunal find that the respondent, by the actions of his real estate agent, has contravened Australian Consumer Law. The customer wanted the tribunal to order the respondent to intersect the material letter of a potential purchaser. Moreover, the tribunal was requested to find that the respondent's agent has failed to uphold the client's interests and had breached his duty under Australian Consumer law.
The approach to dispute resolution
The matter was presented before the NSW Civil and Administrative Tribunal. The tribunal was required to determine if the respondent misrepresented the property and, if so, whether it misled the customer to purchase it. The tribunal was also to consider whether the respondent was vicariously liable for the wrongs committed by his agent.
Hearing arguments
The customer made the first opening statement to explain her issue against the respondent and provide shreds of evidence. The customer argued that the respondent has contravened Australian law by using misrepresentation to induce the sale of property. The respondent had sent the customer a letter with a potential buyer who expressed interest in the property located in Glenwood, New South Wales. The customer bought the property based on the advertisement. The respondent's agent, in his company's letterhead, showed the customer the property to induce her to buy it. The advertisement also claimed that the property had modern features such as a swimming pool, luxury kitchen, and a new bathroom. Despite this, the customer found the property unattractive, and the kitchen was smelly when shown around by the respondent's agent (Australian Consumer Law, 2021).
