Divorce Offers You may apply for a divorce by filing a Notice of Family Claim in the Supreme Court of British Columbia. The actual process of getting a divorce is usually not contested in most cases. However, the courts need to ensure that the parties solve other issues before granting the divorcing decree. Moreover, the court might also need to establish who gets custody, guardianship, access, and how to divide the couple's assets. Before a divorce order is given, the court has to make sure that the children are taken care of financially (s. 11b). For a divorce order to be granted (1) there must be a valid marriage; (2) one party has lived in BC for the last year (Divorce Act s.3); (3) either you or your spouse must prove that the other one was cruel to you or committed adultery or you lived separated for a period of one year. This may be hard to prove if the couples live separately but still share one house. Cruelty and adultery hardly make it to a divorce case. It will take more than one year to prove adultery or cruelty. Separating and leaving apart for twelve months is the best and most common reason for divorce. The court has to be sure that the children have been taken care of by appropriate arrangements (Divorce Act s. 11b). Desk Order Divorce (Unopposed Divorce) If there are no outstanding issues that remain unresolved, the court will grant you a divorce without needing to go to a divorce hearing.
